I remember reading a good thread discussing the navigable waterway laws and I can't seem to find it.....I think I read it here a good while ago. Have always been interested in getting on the East Fork White River (its listed as Navigable), but with the water flucuations, I always chickened out. Watched it like a hawk this year and I really want to set it up next season. My main concern is, if you set your traps in the water do you have to have permission from the landowner who borders the waterway?

If you stay below the high water mark. No as long as you use a boat to access your traps and you can get in the river without crossing privet ground. If you do then you must get permission from the land owner that you must cross the get to the river. But keep this in mind, high water mark dose not mean flood stage. In most cases if you stay inside the banks you will be OK. It is best to know the river real well that you trap And know what is normal and what is flood stage. You need to get with your local CO. and talk to them about what you are going to do because he is the one that you and a land owner will be dealing with if ever there is a problem.
